Kennedy Lambasts Justice Jackson Over Universal Injunction Dissent"},"content":{"rendered":"\n<p>Louisiana Republican Sen. John Kennedy said he was \u201cproud\u201d of the Supreme Court following a Friday ruling that he argued must be good for the country\u2014if only because it appeared to deeply anger Justice Ketanji Brown Jackson.<\/p>\n\n\n\n<p>Appearing on Fox\u2019s Faulkner Focus with anchor Harris Faulkner, Kennedy applauded the Court\u2019s 6\u20133 decision in a case involving birthright citizenship, one of several recent rulings that have drawn sharp backlash from the left.<\/p>\n\n\n\n<p>The ruling effectively struck down lower court injunctions blocking executive orders issued by former President Donald Trump. Faulkner pointed out that the decision could impact more than just Trump\u2019s birthright citizenship order, potentially setting a broader precedent.<\/p>\n\n\n\n<p>\u201cSo this has bigger implications than just that one topic of birthright citizenship,\u201d said Faulkner. \u201cYour reaction to this?\u201d<\/p>\n\n\n\n<p>\u201cThe Supreme Court has turned the universal injunctions into fish food, as well it should have,\u201d said Kennedy. \u201cThere\u2019s no basis in statute. There\u2019s no basis in Supreme Court precedent. There is no basis in English common law for universal injunctions.\u201d<\/p>\n\n\n\n<p>He continued, saying that, \u201cJudges who just dislike what Congress and a president, any president, has done, just made them up. And good riddance. I\u2019m proud of the Supreme Court.\u201d<\/p>\n\n\n\n<p>He then pointed to Justice Jackson\u2019s dissent, which has become a major focus of discussion since the rulings were issued.<\/p>\n\n\n\n<p>\u201cIt\u2019s a very extensive ruling. You can tell it from Justice Jackson\u2019s dissent,\u201d he said. \u201cShe\u2019s mad as a bag of cats, and that\u2019s probably a good thing for the American people.\u201d<\/p>\n\n\n\n<p>After reviewing Trump\u2019s Truth Social post on the matter, Faulkner asked Kennedy to elaborate. He clarified that the Court didn\u2019t rule directly on birthright citizenship, but rather on what he called the \u201cillegal\u201d use of universal injunctions\u2014an authority he said that \u201cfederal judges just made up.\u201d<\/p>\n\n\n\n<p>\u201cYou know, if they disagree, you know, I\u2019m sorry. Fill out a hurt feelings report. Buy a comfort rock,\u201d Kennedy said. \u201cBut they can\u2019t just say, I disagree and I\u2019m putting the entire action by another branch of government on hold because I don\u2019t like it.\u201d<\/p>\n\n\n\n<p>Kennedy&nbsp;<a href=\"https:\/\/www.mediaite.com\/media\/tv\/gop-senator-on-fox-justice-jackson-mad-as-a-bag-of-cats-at-scotus-ruling-and-thats-a-good-thing\/\" target=\"_blank\" rel=\"noreferrer noopener\">added<\/a>&nbsp;that \u201cboth sides have abused it, and by it I mean universal injunctions. The Democrats more than the Republicans, but both sides of abused it. And it\u2019s illegal. There\u2019s no basis for it in law. And I\u2019ve just been waiting for the Supreme Court to do this.\u201d<\/p>\n\n\n\n<p>\u201cI mean, anybody who knows a law book from an L.L. Bean catalog knows that federal judges just made up this concept of universal injunctions,\u201d Kennedy went on.<\/p>\n\n\n\n<p>Justice Amy Coney Barrett&nbsp;<a href=\"https:\/\/conservativebrief.com\/amy-coney-barrett-2-92662\/\" target=\"_blank\" rel=\"noreferrer noopener\">wrote<\/a>&nbsp;the majority judgment for the court. Brown dissented along with Justices Sonia Sotomayor and Elena Kagan.<\/p>\n\n\n\n<p>In her opinion, Barrett wrote: \u201cSome say that the universal injunction \u2018give[s] the Judiciary a powerful tool to check the Executive Branch.\u2019 \u2026 But federal courts do not exercise general oversight of the Executive Branch; they resolve cases and controversies consistent with the authority Congress has given them. When a court concludes that the Executive Branch has acted unlawfully, the answer is not for the court to exceed its power, too.\u201d<\/p>\n\n\n\n<p>Barrett also directly attacked the argument made by Jackson, a Biden appointee.<\/p>\n\n\n\n<p>\u201cWe will not dwell on Justice Jackson\u2019s argument, which is at odds with more than two centuries worth of precedent, not to mention the Constitution itself. We observe only this: Justice Jackson decries an imperial Executive while embracing an imperial Judiciary,\u201d Barrett, who taught law at the University of Notre Dame for years, added.<\/p>\n\n\n\n<p>\u201cIn other words, it is unecessary to consider whether Congress has constrained the Judiciary; what matters is how the Judiciary may constrain the Executive. JUSTICE JACKSON would do well to heed her own admonition: \u2018[E]veryone, from the President on down, is bound by law.\u2019 That goes for judges too,\u201d she wrote.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Louisiana Republican Sen.
