{"id":1244,"date":"2025-07-26T23:47:40","date_gmt":"2025-07-26T23:47:40","guid":{"rendered":"https:\/\/states-news.com\/?p=1244"},"modified":"2025-07-26T23:47:41","modified_gmt":"2025-07-26T23:47:41","slug":"trump-makes-bold-move-to-keep-alina-habba-as-u-s-attorney","status":"publish","type":"post","link":"https:\/\/states-news.com\/?p=1244","title":{"rendered":"Trump Makes Bold Move to Keep Alina Habba As U.S. Attorney"},"content":{"rendered":"\n<p>President Donald Trump used an appointment maneuver to keep acting U.S. Attorney for New Jersey Alina Habba in her post after federal judges in the state, most of whom were appointed by Democratic presidents, named someone else to replace her.<\/p>\n\n\n\n<p>Habba\u2019s 120-day temporary appointment was set to expire at midnight Friday evening, meaning she would have had to step down after the judges instead chose one of her assistants, Desiree Grace, to succeed her earlier this week. The Senate had yet to take up her nomination.<\/p>\n\n\n\n<p>But on Thursday, Trump withdrew her nomination to become the permanent U.S. attorney, according to a Justice Dept. official, and instead appointed her first assistant U.S. attorney, making her acting U.S. attorney again for the time being since that post is vacant, The Hill&nbsp;<a href=\"https:\/\/thehill.com\/regulation\/court-battles\/5419066-trump-withdraws-habbas-nomination-for-top-nj-federal-prosecutor-letting-her-assume-role-in-acting-capacity\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>.<\/p>\n\n\n\n<p>\u201cDonald J. Trump is the 47th President.&nbsp;Pam Bondi&nbsp;is the Attorney General. And I am now the Acting United States Attorney for the District of New Jersey,\u201d Habba said in a statement&nbsp;<a href=\"https:\/\/x.com\/USAttyHabba\/status\/1948489536507707793\">posted<\/a>&nbsp;to the social platform X. \u201cI don\u2019t cower to pressure. I don\u2019t answer to politics. This is a fight for justice. And I\u2019m all in.\u201d<\/p>\n\n\n\n<p>Grace had previously declared she was ready to step into the role, escalating the standoff to a new level after Bondi fired her following the judges\u2019 decision to appoint her over Habba.<\/p>\n\n\n\n<p>Grace wrote&nbsp;<a href=\"https:\/\/www.linkedin.com\/posts\/desiree-grace-78288115_it-has-been-the-honor-of-a-lifetime-to-represent-activity-7353908927010328576-ksOH\/?utm_source=share&amp;utm_medium=member_desktop&amp;rcm=ACoAABHS6X0BpzwvUiQ4bkljgeAHTUO-ARLoFKY\" target=\"_blank\" rel=\"noreferrer noopener\">on LinkedIn<\/a>&nbsp;earlier Thursday that she\u2019s honored by her appointment \u201con merit\u201d and is ready to take on the role \u201cin accordance with the law.\u201d<\/p>\n\n\n\n<p>\u201cI\u2019ve served under both Republican and Democratic administrations,\u201d Grace wrote. \u201cI\u2019ve been promoted four times in the last five years by both \u2014 including four months ago by this administration. Politics never impacted my work at the Department. Judges on the U.S. District Court for the Northern District of New York declined to extend the interim term of John Sarcone III, Trump\u2019s nominee for the district\u2019s chief federal prosecutor, The Hill noted.<\/p>\n\n\n\n<p>To circumvent the decision, Sarcone was designated a \u201cspecial attorney\u201d to Bondi, granting him the authority of a U.S. attorney indefinitely.<\/p>\n\n\n\n<p>Fox News added that Habba resigned her post on Thursday, giving Trump an opening to re-appoint her to her current post, which has a 210-day limit.<\/p>\n\n\n\n<p>\u201cTrump has also nominated Habba to serve the full, four-year role as the permanent U.S. attorney, but that position requires Senate approval and Habba has no clear path to confirmation,\u201d Fox reported.<\/p>\n\n\n\n<p>That\u2019s because New Jersey\u2019s two Democratic senators, Cory Booker and Andy Kim, are currently blocking her nomination using the Senate\u2019s \u201cblue slip\u201d tradition. Meanwhile, a source familiar with the situation said the Trump administration has yet to submit any materials for the Senate to formally review Habba\u2019s nomination.<\/p>\n\n\n\n<p>In a statement, Booker claimed that the Trump administration had violated the law by dismissing Grace.<\/p>\n\n\n\n<p>\u201cThe firing of a career public servant, lawfully appointed by the court, is another blatant attempt to intimidate anyone that doesn\u2019t agree with them and undermine judicial independence,\u201d Booker wrote on social media, according to Fox News. \u201cThis Administration may not like the law, but they are not above it.\u201d<\/p>\n\n\n\n<p>In May, Habba&nbsp;<a href=\"https:\/\/conservativebrief.com\/mciver-ice-91752\/\" target=\"_blank\" rel=\"noreferrer noopener\">brought federal charges<\/a>&nbsp;against Rep.
